What happens if your neighbor's tree falls on your property and hits your home?

IS YOUR NEIGHBOR’S INSURANCE COMPANY LIABLE TO PAY FOR THE DAMAGES?

Falling trees and limbs cause millions of dollars in damage each year. It does not matter if a tree on your property falls during a windstorm or another natural disaster. Will your home insurance cover the damage? The answer will depend up on the circumstances.

Every homeowner  should look at their policy to see what the policy specifically covers and does not cover. The policyholder should know what the policy deductible is and limits on the amount of damage the policy will cover.

Listed below are some common questions about fallen trees and coverage issues.

WILL MY POLICY COVER DAMAGE FROM A TREE?

A standard policy will cover damage to your home and contents of your home if a tree – even your neighbor’s tree -- falls on your home or other insured structures. This would include trees that fall because of wind, hail, ice, snow and sleet.

WILL MY POLICY COVER TREE REMOVAL?

Your policy may have a limited amount (usually $500 to $1,000) to remove a fallen tree from your property. If you have one tree or ten trees that fall, you will receive the same amount.

WHAT HAPPENS IF A TREE FALLS IN MY YARD AND DOES NOT HIT ANY STRUCTURE?

If nothing that was insured (structure or appurtenant structure) was damaged, there  generally isn’t  any coverage.

IF A TREE FALLS IN MY YARD, BUT DOES NOT DAMAGE MY HOME OR PROPERTY, WILL MY POLICY PAY FOR DEBRIS REMOVAL AND CLEAN UP?

Generally, the fallen tree must damage your home or property before the policy will pay for cleanup and removal, ;however, some policies provide limited coverage for cleanup and removal of trees if, for  example, they fall and block your driveway.

IF A NEIGHBOR’S TREE FALLS ON MY PROPERTY AND HITS MY HOUSE, SHOULD THE NEIGHBOR’S INSURANCE COMPANY PAY?

Unless negligence can be proven, the neighbor’s policy cover his or hers and your policy covers your home. If the tree was damaged because of a storm, the owner would not be considered negligent. However; if your neighbor’s tree was dead and the neighbor already knew that and he or she were officially notified, then your home insurance company might seek restitution from your neighbor’s insurance company.

A TREE ON MY PROPERTY FALLS ON MY NEIGHBOR’S HOUSE. DOES MY POLICY PAY THE DAMAGE CAUSED BY THE TREE? WHO PAYS TO REMOVE THE TREE?

The neighbor’s policy covers his or her home and your policy covers your home. The neighbor’s policy would pay to have the tree removed.

WILL MY INSURANCE COMPANY PAY TO REMOVE A DAMAGED TREE THAT’S LEANING TOWARD MY HOME?

An insurance company covers damages, not the threat of damage. A home insurance company is not a intended to act as a maintenance policy.
